The New Blazing Star Press End-User License Agreement (“EULA”) is a legal agreement between you (either an individual or a single entity) and New Blazing Star Press for the New Blazing Star Press’ software product(s), which may include associated software components, media, printed materials, and “online” or electronic documentation (“Software”). The Software is licensed, not sold. Therefore, the price paid for the Software is a licensing free which grants you only the rights contained in this Agreement. By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA.
By accepting this agreement, effective the date you acquire the Software, the New Blazing Star Press grants to you a limited, non-exclusive and revocable license to use the Software, and only in a machine-readable, object code form.
If the Software is to be used for personal use, it may be installed and used on computers which you personally own.
If the Software is to be used for commercial use, the Software is licensed and may be installed and used on one computer per license. A new license must be purchased for each computer on which the Software will be installed.
You may make copies of the Software as may be necessary for backup and archival purposes.
If you are using the fonts in producing professional work and need to send copies of the fonts to the printshop, you may do so provided that the print house deletes them when the job is done.
(a) Maintenance of Copyright Notices.
You must not remove or alter any copyright notices on any and all copies of the Software.
You may not distribute registered copies of the Software to third parties or sublicense any copy to any person for any purpose.
(c) Prohibition on Modification, Reverse Engineering, Decompilation, and Disassembly.
You may not modify, reverse engineer, decompile, or disassemble the Software, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
You may not rent, lease, or lend the Software.
The Software and license may be transferred to another party by transferring the original media and all related documentation to the new recipient who then shall agree to the terms of this EULA.
Without prejudice to any other rights, The New Blazing Star Press may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the Software in your possession.
The New Blazing Star Press warrants any physical media containing the Software to be free from defect for a period of 60 days from the date of purchase, and if notified during the warranty period, The New Blazing Star Press will replace the media or refund the purchase. The New Blazing Star Press expressly disclaims any other warranty for the Software, or its fitness for any use or purpose.
In no event shall The New Blazing Star Press be liable for any damages (including, without limitation, lost profits, business interruption, or lost information) rising out of ‘Authorized Users’ use of or inability to use the Software, even if The New Blazing Star Press has been advised of the possibility of such damages. In no event will The New Blazing Star Press be liable for loss of data or for indirect, special, incidental, consequential (including lost profit), or other damages based in contract, tort or otherwise. The New Blazing Star Press shall have no liability with respect to the content of the Software or any part thereof, including but not limited to errors or omissions contained therein, libel, infringements of rights of publicity, privacy, trademark rights, business interruption, personal injury, loss of privacy, moral rights or the disclosure of confidential information.
